Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Dalyon (the “Service”). The Service is operated by Vipertrading GmbH, Canton of Aargau, Switzerland (“Vipertrading GmbH”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Dalyon is a real-time market-data and charting tool for US equities. It surfaces price, volume, and momentum information together with related analytics and visualizations.

We may change, suspend, or discontinue any part of the Service at any time, and we will give reasonable notice of material changes where practicable.

The Service provides information and tools only. It is not investment, financial, legal, or tax advice, and it is not a recommendation, solicitation, or offer to buy or sell any security.

We are not a broker-dealer, investment adviser, or financial-planning service, and your use of the Service creates no advisory or fiduciary relationship. Market data may be delayed, inaccurate, or incomplete and must be independently verified before you rely on it.

Trading securities involves substantial risk, including the possible loss of your entire investment. Past performance and any signal, scan, or setup shown through the Service do not predict future results. You are solely responsible for your own trading and investment decisions and for complying with the laws that apply to you.

Your account is personal to you. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree not to share your access. Notify us promptly at operations@dalyon.com if you suspect unauthorized use.

The Service is offered on a paid subscription, with a free trial where stated. A valid payment method is required to start a trial. Unless you cancel during the trial, your subscription begins and your payment method is charged automatically at the end of the trial, and it renews each billing period until cancelled.

You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees are shown at sign-up and may change for future periods with prior notice. Payments are processed by a third-party payment provider, and we do not store full card details.

All payments are final and non-refundable. We do not provide refunds under any circumstances, regardless of the reason.

You agree not to:

• use the Service unlawfully or in breach of securities or market regulations;
• resell, redistribute, or publicly display the Service or its data;
• scrape, copy, or extract any data from the Service;
• reverse-engineer the Service or circumvent its technical limits or security;
• share your credentials, exceed your licensed access, or interfere with the Service’s operation or other users.

The Service, including its software, design, and content, is owned by Vipertrading GmbH and protected by law. We grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Service for your personal purposes for the duration of your subscription. Market data is provided by third parties and remains theirs; your use of it may be subject to their terms.

The Service and all data are provided “as is” and “as available”, without warranties of any kind, whether explicit or implied. This includes any implied warranties of merchantability, fitness for a particular purpose, accuracy, and uninterrupted or error-free operation. We do not guarantee that the Service or its data will meet your requirements or that defects will be corrected.

Vipertrading GmbH is not liable for any direct, indirect, incidental, or consequential damages, or for any trading or investment losses, lost profits, or lost data arising from your use of the Service.

We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or third parties. You may stop using the Service and cancel your subscription at any time, but you remain responsible for payment through the end of your current billing period.

We may update these Terms from time to time. For material changes, we will take reasonable steps to notify you, such as by email or within the Service. Your continued use after the changes take effect means you accept the updated Terms.

These Terms are governed by the substantive laws of Switzerland. The exclusive place of jurisdiction is the registered seat of Vipertrading GmbH in the Canton of Aargau, Switzerland.
